Protecting the Rights of Tennessee Clients during Civil Appeals

Skilled appellate attorneys serving Sevierville, Pigeon Forge, Gatlinburg and beyond

When a judge or jury renders a verdict in a civil trial (meaning any trial that is not a criminal trial), you or your opponent may be able to take your case to a higher court. In Tennessee, that is the Court of Appeals. When you wish to pursue an appeal or need to defend yourself on appeal, you want an attorney who knows what is at stake, and what it takes to win – and that means you want the team at Delius & McKenzie, PLLC. Our Sevierville appellate attorneys fight on behalf of clients in need of justice, and advocate aggressively for your rights and your future. From Gatlinburg to Pigeon Forge, from the West to the East, we are the team you can trust to help you take back control of your life.

What you should know about civil appeals

Just like with criminal appeals, civil appeals might also go through a number of courts. You start with the Tennessee Court of Appeals, who will decide:

  • To side with the original judge
  • To find for you instead, and overturn the original decision
  • To remand the case back to the original court for further review or a new trial

There are no juries, no witnesses and no expert testimonies: only written and oral arguments presented to a panel of three judges. If the panel affirms with the original court, the losing party can then ask the Tennessee State Supreme Court to hear the case. In every case, we make strong arguments for our clients—whether our clients are pursuing the appeals or responding to an appeal.

Because civil appeals are often filed by either parties, it is important to have an attorney that has experience representing both the parties appealing (called “appellants”) and parties defending the original court judgment (called “appellees”). For example: if you are hit by a car and awarded no compensation by the local court, you can appeal that decision so you can obtain the compensation you need to survive. However, if you are hit by a car and awarded compensation, the insurance company of the person who hit you can also appeal that decision, and you may find yourself left with nothing if their appeal succeeds. Our firm has successfully helped plaintiffs overturn adverse decisions by trial courts dismissing their lawsuits and helped plaintiffs keep their judgments when the at-fault party appealed the court’s verdict.

For this reason, it is very important that you choose a Sevierville appellate lawyer who not only understands the laws, but who has real-world trial experience. The team at Delius & McKenzie, PLLC has successfully represented clients in local, state and federal courts throughout Tennessee, as well as in our appellate court system. We have the skills and the resources to handle the complexities of appellate work, and the drive to see your case through to the end. When you need a fighter who will be by your side, you can rely on us.

What types of civil cases can be appealed?

Technically, any “kind” of civil case can be appealed, provided there is adequate evidence that the court made a mistake, or that your civil rights were violated during the course of the trial. As Sevierville personal injury attorneys, we usually handle appeals in that practice area. Some of the cases we have taken on include:

  • Auto and commercial truck accidents
  • Premises liability
  • Product liability
  • Wrongful death
  • Negligent employment actions
  • Construction accidents
  • Insurance bad faith

Though this list is far from complete, we promise that our appellate services are thorough, detailed and prepared with care. Time is of the essence when you wish to file an appeal, so it is important that you make time to see us soon.
